1. Introduction
Welcome to Spray Foam Removal UK (“we”, “us”, “our”). These Terms & Conditions govern your access to and use of our website at https://sprayfoamremoval-uk.co.uk (the “Site”) and the services we provide through it. By accessing the Site, requesting an estimate, or otherwise using our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.
The Site is operated by Spray Foam Removal UK (referred to in these Terms as “we”, “us” or “our”). Spray Foam Removal UK is a trading name; our business contact details are set out in section 18.
2. What We Do — and What We Do Not Do
Spray Foam Removal UK helps homeowners who are affected by problematic spray foam insulation. Our role is to:
- Provide information and guidance about spray foam insulation and the issues it can cause with mortgages, remortgages, equity release, property sales and surveys;
- Provide indicative cost estimates based on the information you give us;
- Connect you with approved, independent specialist contractors who carry out spray foam removal, surveys and related roofing work; and
- Provide supporting documentation where applicable.
Spray Foam Removal UK is not a roofing contractor and does not itself carry out any spray foam removal, survey, roofing or other physical works. All such works are carried out by independent third-party specialist contractors. Where our website refers to “we”, “our team”, “our technicians” or similar in connection with on-site works, this describes the network of approved contractors we work with on your behalf, unless the context clearly relates to our own information and coordination services.
We accept no liability whatsoever for any works carried out on site. All liability for the works — including their quality, safety, completion, compliance and any resulting loss or damage — rests solely with the contractor carrying out those works.
We are not a roofing contractor, mortgage lender, financial adviser, insurer, surveyor, structural engineer or legal adviser. Nothing on the Site constitutes professional advice of any kind (see also our Disclaimer).
3. Estimates and Quotes
- Any estimate provided through our free online estimate tool or by telephone or email is an indicative figure only, based on the information you supply. It is not a binding quotation.
- A firm, binding quotation can only be given by the appointed contractor following a survey or on-site assessment.
- Prices, timescales and the scope of works may change once the property has been inspected, for example if the age or condition of the roof, the type of foam, or the method of installation differs from the information originally provided.
- We do not guarantee that any particular number of quotes or responses will be provided.
4. The Connection Service and Your Contract with Contractors
When you submit an enquiry or estimate request:
- Your details may be shared with one or more approved specialist contractors so they can contact you and provide a quotation (see our Privacy Policy);
- Any contract for the carrying out of works is formed directly between you and the contractor, not with us;
- You are under no obligation to accept any quotation;
- The contractor is solely responsible for the works they carry out, including the quality, safety, timeliness, pricing and any guarantees, certificates or warranties they provide; and
- Any consumer cancellation or “cooling-off” rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply to the contract between you and the contractor, and the contractor is responsible for honouring them.
5. Guarantees and Insurance-Backed Warranties
Any 10-year insurance-backed guarantee, workmanship warranty or accreditation (including Confederation of Roofing Contractors membership) referred to on the Site is provided and underwritten by the relevant contractor, accrediting body or insurer — not by us. We make no representation or warranty as to the validity, scope or enforceability of any such guarantee, and any claim under it must be pursued with the contractor or provider concerned.
6. Third-Party Contractors
We carry out reasonable checks on the contractors in our network. However, we:
- Do not employ them and do not control how they carry out their work;
- Do not guarantee their work, certifications or conduct;
- Are not responsible for the quality, cost, timeliness or outcome of their services; and
- Are not a party to, and accept no liability for, any dispute between you and a contractor.
7. Accuracy of Information
While we take care to keep the information on the Site accurate and up to date:
- We make no warranty that it is complete, reliable, current or error-free;
- Industry guidance, lender policies, regulations and pricing change frequently and may not be reflected immediately; and
- You should independently verify any information that is important to your decisions, and take appropriate professional advice.
8. Your Responsibilities
When using the Site, you agree to:
- Provide accurate, truthful and complete information in any form or communication;
- Use the Site and our services only for lawful purposes;
- Not misuse, disrupt or attempt to gain unauthorised access to the Site or its systems; and
- Respect our intellectual property and that of our content suppliers.
9. Intellectual Property
All content on the Site — including text, graphics, logos, images, video and design — is owned by us or our content suppliers and is protected by UK and international intellectual property laws. You may not copy, reproduce, distribute or create derivative works from it without our prior written permission, except for normal personal use of the Site.
10. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law (including your statutory rights as a consumer under the Consumer Rights Act 2015).
Subject to that, and to the fullest extent permitted by law:
- We are not liable for any indirect or consequential loss, or for loss of profit, opportunity, sale, or goodwill arising from your use of the Site or our connection service;
- We are not responsible for decisions you make based on information found on the Site or for the actions or omissions of any contractor; and
- We do not warrant that the Site will be uninterrupted, secure or free from errors.
Your use of the Site and our services is at your own risk.
11. Indemnity
You agree to indemnify and hold harmless Spray Foam Removal UK and its owner, staff and representatives from any claims, losses, damages or expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, your dealings with any contractor, or any inaccurate information you provide.
12. External Links
The Site may contain links to third-party websites. We do not control or endorse these sites and are not responsible for their content, terms or privacy practices. You access them at your own risk.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your personal data.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with the “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Suspension and Termination
We may suspend or withdraw access to the Site at any time, without notice, where reasonably necessary, including for breach of these Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Disputes arising from them or your use of the Site are subject to the exclusive jurisdiction of the courts of England and Wales. This does not affect any mandatory consumer protections available to you under the law of the part of the UK in which you live.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
